Abstract
This Law consisting of 24 articles is a legal framework that aims to set technical standards for products and ensure their compliance in order to promote fair trade in the market and enhance the competitiveness of the national economy. This System stipulates the role and powers of the Saudi Standards, Metrology and Quality Organization (SASO). Under Article 3, standardization is guided by principles, including the participation of all relevant stakeholders, transparency in the approval process, and consistency with related documents. It also considers technical progress, sustainable development, and commitments to international agreements, all while ensuring there is no discrimination between local and imported products. The primary objectives of standardization activities are detailed in Article 4 as follows (i) ensuring a high level of protection of the life, health, and safety of humans and animals, as well as protecting plants, property, security, and the environment; (ii) contributing to enhancing the competitiveness of the national economy; (iii) promoting fair trade in the market; (iv) protecting and promoting consumer interests and expectations; (v) improving the use of resources and energy, and promoting sustainable production and consumption patterns; (vi) facilitating trade exchanges with relevant parties by removing unnecessary technical barriers; (vii) contributing to improving product and service quality.
Article 5 establishes that the Saudi Standards, Metrology and Quality Organization (SASO) is the sole authority for standardization and quality activities, with the exception of those handled by the Saudi Food and Drug Authority. Its main tasks are: (i) Strategic Planning and Implementation: SASO develops and oversees the national strategy for standards; (ii) Standards Development and Management: Its tasks include preparing, reviewing, and withdrawing standards, in addition to creating and updating a comprehensive guide to them; (iii) International and Regional Collaboration: SASO participates in the development of international standards and represents Saudi Arabia in international and regional standardization organizations; (iv) Public Access and Promotion: SASO makes standards available to the public and acts as a reference body, working to encourage their adoption.
SASO prepares a national quality strategy in coordination with relevant authorities, submits it for approval in accordance with regulatory procedures, and supervises its implementation after its approval (Article 14). It may launch competitions and undertake quality initiatives to improve product and service quality in the Kingdom of Saudi Arabia (Article 16). Furthermore, SASO grants quality marks and other certifications, and unauthorized use of these marks is prohibited; those who are granted a license must comply with the conditions of use and cease use upon expiration. Non-compliance can result in penalties such as warnings, fines, or other sanctions as specified by the Regulations.
