Abstract
The objective of this Act is to provide for the conservation of biological diversity and the sustainable use of its components. The Act is composed by 11 Parts.
Part 1 is a preliminary part mainly covering interpretation issues.
Part 2, which is dedicated t the National Advisory Committee, regulates its constitution, composition and functions, which include advisory, consulting and recommending the Minister on matters covered under this Act.
Part 3 concerns the protected areas, their designation and classification into one of the categories listed at point 5.(1) as well as the procedure for their designation, including the private submission of proposals to designate an area as a protected area. It finally covers the revocation of designation.
Part 4 foresees the interim protection status, which may be recognized by the Minister to a specified area in order to safeguard the natural features and wildlife of the area or assess a threat of harm to the area, wildlife or to the anthropogenic development in that area.
Part 5 provides that the Minister may also designate, by a notice, an area as a seasonally protected area. This Part describes the information that such notice must contain.
Part 6 concerns the management of a protected area, the activities which may be allowed in a protected area as well as the development of a protected area, which can be carried on by its owner on the basis of the category under which that area has been designated provided that the provisions and requirements of the laws regulating environment protection, development and planning and any other relevant written laws are complied with.
Part 7 sets guidelines and conditions for access into protected areas as well as, in case, entrance fees.
Part 8 regards enforcement and compliance and includes the appointment of authorized officers and their powers, the engagement of private security services.
Part 9 provides for offences and penalties while Part 10 regulates the appeals, for the purposes of this Act, to the Appeals Board
The Act is terminated by Part 11, on miscellaneous issues.
