Act (2026:310) on the making available on the market of EU fertilising products.

This Act lays down rules supplementing and implementing European Union Regulation 2019/1009 on EU fertilising products, primarily through rules on market surveillance, enforcement, and sanctions. It designates a market surveillance authority with powers to inspect products and premises, require corrective measures, restrict online offerings, issue binding orders backed by fines, and, where necessary, obtain police assistance. The Act also provides for administrative penalty fees for non-compliance by manufacturers, importers, and distributors with obligations relating to conformity assessment, CE marking, labelling, documentation, and product safety, while establishing appeal procedures and transitional rules replacing earlier legislation on EC fertilizers and market control.
