Abstract
This Act contains provisions on the market surveillance of products to ensure compliance with the requirements set out in the European Parliament and Council Regulation (EU) 2019/1009 establishing rules for the marketing of EU fertilizer products. The authority designated by the government shall be the market surveillance authority. The market surveillance authority shall have the power to: 1) Require economic operators to provide documents, specifications, data, or information in accordance with Article 14.4 a-c; 2) Conduct unannounced on-site inspections and physical checks of products according to Article 14.4 d; 3) Access premises, land, or means of transport under Article 14.4 e; 4) Initiate investigations on its own initiative as per Article 14.4 f; 5) Require economic operators to take appropriate measures to eliminate non-compliance or to address a risk according to Article 14.4 g; 6) Take action itself in accordance with Article 14.4 h; 7) Acquire, inspect, and dismantle product samples under Article 14.4 j; 8) Demand that content on an online interface be removed, that a warning be displayed, or that access be restricted as stated in Article 14.4 k.
