Abstract
The present Act sets out the legal framework governing the authority of the Swedish Customs Agency (Tullverket) and its officers in the areas of customs control and crime prevention. The law outlines both general and specific powers applicable at Sweden’s external and internal borders, including the inspection of goods, transport vehicles, and passengers. It provides legal backing for searches, detentions, and seizures related to customs matters and ensures coordination with other authorities when necessary. The Act also addresses individuals’ obligations toward customs officials, such as providing access and necessary documentation during controls, and allows for administrative actions like fines and forfeiture of goods when regulations are breached.
The Act is organized into eleven chapters that define powers related to surveillance, investigation, prosecution, and crime prevention, as well as rules on conflict of interest and penalties. It incorporates and complements various EU regulations, such as the Union Customs Code and laws governing the cross-border movement of cash and protection of intellectual property rights. Provisions also enable customs officers to use force under specific conditions, stop vehicles or vessels, and conduct body searches when justified. In addition, the Act regulates procedures for handling excise-duty goods and mandates how seized items may be sold or destroyed. This comprehensive legislation ensures that Swedish customs operations comply with both national and EU standards while safeguarding public order and state revenue.
