Abstract
The present Regulation supplements the Customs Powers Act (2024:710), laying out detailed rules for how the Swedish Customs Authority (Tullverket) may exercise its powers. It regulates customs control operations at both external and internal borders, including the inspection of persons, goods, and vehicles. It incorporates and complements EU regulations such as the Union Customs Code (EU 952/2013), legislation on intellectual property enforcement (EU 608/2013), and rules on the movement of cash across borders (EU 2018/1672). The Regulation specifies when and where customs officers may stop individuals, how seized goods are to be handled and sold, and under what conditions customs, police, and coast guard cooperate in enforcement.
The Regulation also defines the delegation of authority within Tullverket for investigating crimes, using coercive measures, and accessing transport booking records. It mandates specific qualifications for customs officers who carry out investigations or apply force, ensuring oversight and legal compliance. The final chapters authorize Tullverket to issue further rules necessary for enforcing the regulation and collaborating with other authorities. In effect, this Regulation operationalizes Sweden's customs enforcement by detailing procedures, powers, and inter-agency coordination, ensuring alignment with EU law while maintaining national legal integrity.
