Decree SFS 2012:525) amending Decree (1994:1716) relative to fishing, use waters and fish culture.

This Decree partly amends Decree (1994:1716) with regard to the Marine and Water Authorities' decisions on derogating articles 5-6 and 13 (sect. 1 and 2) if there is scientific or other special reasons for it. If the exemption applies only to articles 5-6 the Marine and Water Authority may issue regulations (or in the case for an exception from articles 2, 4-6, 11) if the fishing is on behalf of the Authority. The Marine and Water Authority considers matters concerning authorizations for fishing activities for scientific purposes, according to EU regulations on the common fisheries policy. A court shall immediately notify the judgment in accordance to the Fisheries Act (1993:787) to the Swedish Board of Agriculture if the judgment relates to the movement of fish from fish farms or farming of fish (1), and/or to the Marine and Water Authority in other cases (2).
