Abstract
This Act establishes the legal foundation for a specialized public entity tasked with the management of state-owned agricultural lands, farms, and forests. It defines the Fund as a legal person operating under the regulations governing public institutes, performing tasks in the name and for the account of the Republic of Slovenia. Its primary mandate involves ensuring the rational use and environmental preservation of these natural assets in accordance with national development policies, which it achieves through administrative actions such as leasing, granting concessions, and managing land transactions.
The governance structure of the Fund is centered on a council composed of representatives from the founder, users, and employees, with its executive leadership and financial transparency overseen by the National Assembly and the ministries responsible for agriculture and finance. Financing for the Fund's operations is derived from the income generated through land management, supplemented by the national budget, with funds specifically earmarked for maintaining production capacity, purchasing new land, and developing forest functions.
A critical component of the Act addresses the transition from social property to state and municipal ownership, providing the mechanisms for the Fund to act as the legal successor to previous managers of social land and forests. Furthermore, the Act integrates the Fund into the national denationalization process, designating it as the entity responsible for the restitution of land to former owners or the provision of compensation. This includes the management of specific financial instruments such as vouchers and the transfer of a portion of revenues to the Slovenian Compensation Fund to settle historical claims. Through these provisions, the Act serves as a vital bridge between the socialist era and a modern market-oriented system of resource management.
