Decree on the concession for the use of water for the production of electricity in hydroelectric power plants of up to 10 MW rated power, for which a water management permit has been obtained.

This Decree is a concession act on the basis of which a concession is granted on individual parts of water bodies of surface waters for the use of water for the production of electricity in hydroelectric power plants with a nominal power of up to 10 MW. This type of concessions shall be granted to holders of water management permits, on the basis of which they have the right to use of water in existing hydroelectric power plants on parts of water bodies of surface waters from the Annex, which is an integral part of this text. The concessionaire for the production of electricity in a hydroelectric power plant must, in addition to the prescribed conditions, also provide the following measures: insurance of land, buildings, devices and other goods against the harmful consequences of hydroelectric power plant operation; enabling the general use of water in the concession area; preservation of biological diversity and protection of habitats and biological balance where possible and long-term stable; preservation of the natural value to the greatest extent possible, if it is in the area of the concession; protection of residents and their property against damage caused by the consequences of water use.
