Abstract
This Decree determines the competent authority, weighing, methods of first sale, separately for small and large quantities, mandatory documents and labels accompanying fishing, first sale and sale of fishery products, obligations of fishing vessels in relation to lost fishing gear and traceability of fishing vessels and fishery products and products from aquaculture, for the implementation of: Council Regulation (EC) No. 1005/2008 establishing a Community system to prevent, deter and eliminate illegal, unreported and unregulated fishing, amending Regulations (EEC) No. 2847/93, (EC) No. 1936/2001 and (EC) No. 601/2004 and repealing Regulations (EC) No. 1093/94 and (EC) No. 1447/1999; Commission Regulation (EC) No. 1010/2009 laying down detailed rules for the implementation of Council Regulation (EC) No. 1005/2008 establishing a Community system to prevent, deter and eliminate illegal, unreported and unregulated fishing; Council Regulation (EC) No. 1224/2009 establishing a Community control system for ensuring compliance with the rules of the common fisheries policy, amending Regulations (EC) No. 847/96, (EC) No. 2371/2002, (EC) No. 811/2004, (EC) No. 768/2005, (EC) No. 2115/2005, (EC) No. 2166/2005, (EC) No. 388/2006, (EC) No. 509/2007, (EC) No. 676/2007, (EC) No. 1098/2007, (EC) No. 1300/2008, (EC) No. 1342/2008 and repealing Regulations (EEC) No. 2847/93, (EC) No. 1627/94 and (EC) No. 1966/2006; Commission Implementing Regulation (EU) No. 404/2011 laying down detailed rules for the implementation of Council Regulation (EC) No. 1224/2009 establishing a Community control system, for ensuring compliance with the rules of the Common Fisheries Policy; Regulation (EU) No. 1379/2013 of the European Parliament and of the Council on the common organisation of the markets in fishery and aquaculture products, amending Council Regulations (EC) No. 1184/2006 and (EC) No. 1224/2009 and repealing Council Regulation (EC) No. 104/2000.
The text is divided into main thematic parts and a total of articles. Titles of these main parts are listed as follows: I. General provisions; II. First sale of fishery products; III. Traceability of fisheries and aquaculture products; IV. Control; V. Penalty provisions; VI. Final provisions. The competent authority for the implementation of this text is the ministry. In accordance with Article 48 of Regulation 1224/2009/EC, a fishing vessel must have equipment for retrieving lost fishing gear; these provisions does not apply to: fishing vessels whose total length is less than 12 meters; and fishing vessels and which: operate exclusively in the territorial waters of the Republic of Slovenia and they are never at sea for more than 24 hours from departure to return to port. Article 5 defines rules regarding the vessel monitoring satellite system; weighing of fishery products is regulated in article 6; completion and submission of logbooks and landing declarations are laid down in article 9; completion and submission of the notice of sale is determined in article 10; article 11 regards the submission of the transport documentation; article 12 regards the completion and submission of the takeover declaration; traceability of shipments of fishery and aquaculture products is regulated in articles 14, 15 and 16 (ability to track and monitor fishery and aquaculture products through all stages from catch, processing, first sale, distribution to retail sale); related penalty provisions are listed in article 18.
