Abstract
This Regulation establishes the mechanism for identifying, evaluating, and screening public and private development projects that pose a risk to ecological stability. It sets out a standardized process to determine whether a proposed infrastructure or industrial project must undergo a full environmental evaluation prior to receiving state construction and operating permits.
Projects are categorized into two separate tracks based on numerical capacity, physical size, or potential risk thresholds. High-risk installations automatically fall under a mandatory environmental impact assessment track, requiring developers to complete extensive reporting before any development can proceed. Medium-risk or smaller-scale interventions undergo a case-by-case preliminary screening process managed by the ministry responsible for environmental protection to determine if a full assessment is warranted.
Strict anti-circumvention provisions are embedded within the text to regulate project modifications and prevent the splitting of large developments. Multiple projects that share geographical boundaries, technical dependencies, or corporate ownership are legally treated as a single cumulative intervention. If the combined total of these linked operations exceeds the specified safety thresholds, the entire development is pulled into the state screening process. The Regulation applies these standards across multiple sectors, including energy production, waste management, mining, transport infrastructure, and large-scale agriculture.
Administrative compliance requires developers to submit detailed technical portfolios during the screening phase. Applications must document the baseline health of the local environment, resource consumption rates, expected industrial emissions, and planned waste generation profiles. The Regulation also empowers the ministry to initiate environmental reviews independently if an unpermitted project is discovered. Failure by a developer to supply the necessary documentation within the designated timeline results in an automatic escalation to a mandatory, full-scale environmental impact assessment.
