Regulation on the production and marketing of seed of conservation varieties and varieties developed for growing under particular conditions.

This Regulation of the Minister of Agriculture, Forestry and Food establishes: (1) particular requirements for seed production; (2) particular requirements for seed quality and the packaging and labeling of seeds; (3) the maximum quantity of seed of conservation varieties which may be cultivated and marketed; (4) deadlines and manner of reporting on the production and marketing of seeds; (5) details on official controls of the production and marketing of seed of conservation varieties and varieties developed for growing under particular conditions. This Regulation is composed of 19 articles divided into the following Sections: General provisions (Sec. 1); Particular requirements for seed of conservation varieties (Sec. 2); Particular requirements for seed of other varieties (Sec. 3); Information, monitoring and control (Sec. 4); Final provisions (Sec. 5).
Section 2 outlines specific agronomic, geographical, and quantitative conditions for the multiplication and commercial distribution of conservation varieties. Production must occur within defined regions of origin to preserve genetic diversity and prevent genetic erosion. The Regulation establishes maximum annual quantity limits per species for seed production and marketing, ensuring that conservation seeds remain targeted at localized biodiversity preservation rather than large-scale industrial distribution. Seed lots must fulfill minimum analytical purity and germination standards, and official labels or supplier documents must clearly indicate the region of origin alongside the protected conservation status.
Sections 3 through 5 detail additional requirements for vegetable varieties developed for growing under particular conditions, operational reporting mechanisms, and official verification procedures. Seed suppliers must notify the competent authority of intended production volumes, parcel locations, and distribution metrics prior to marketing. Official post-control inspections and sampling are conducted to verify varietal identity, health, and packaging compliance. Non-compliance with designated quantitative caps, reporting deadlines, or labeling provisions restricts the right to market certified seed batches under these special statutory categories.
