Abstract
This Act establishes the fundamental legal criteria for the cultivation of grapevines and the commercial production of wine and other grape-based products. It defines the mandatory procedures for vineyard registration and the classification of wine-growing areas into specific regions and districts. The Act aims at ensuring that all viticultural activities are traceable and that the origin of the raw material is legally verifiable.
Quality control is managed through a graduated quality scale that categorizes wine based on sugar levels at harvest and specific production methods. The Act sets precise technical standards for various tiers, ranging from table wines to premium wines and special harvest "predicates" such as late harvests or ice wines. These categories are defined by objective metrics, including minimum natural alcohol content and chemical composition, to maintain consistency across the industry.
To ensure consumer protection and product integrity, the Act mandates a rigorous official assessment process. Before any wine can be marketed with a quality designation, it must undergo both laboratory chemical analysis and organoleptic evaluation by an authorized professional panel. This vetting process verifies that the product is free of defects and meets the specific sensory characteristics required for its declared status or traditional denomination.
The Act also dictates strict standards for the labeling, packaging, and marketing of wine. It requires the disclosure of essential information, including alcohol volume, sweetness level, and potential allergens, while recently incorporating requirements for nutritional data and ingredient lists. These rules prevent the use of misleading descriptions and ensure that all additives or processing aids are handled according to established safety protocols.
Finally, the Act provides the legal basis for oversight and enforcement through state inspections and authorized monitoring bodies. It outlines the penalties for non-compliance, such as the unauthorized planting of vineyards or the adulteration of products.
