Abstract
This Act establishes the Environment Protection Agency, defines its functions and powers, provides for its organization and administration and provides rules for various matters regarding the environment in Sierra Leone such as environmental impact assessment and the control of ozone-depleting substances.
The Agency is established as a body corporate and shall be managed by Board of Directors and an Executive Director. The Agency shall, among other things: (a) advise the Minister on environmental issues; (b) provide measures for the control of pollution; (c) issue environmental permits and pollution abatement notices; prescribe standards and guidelines relating to ambient air, water and soil quality, etc.; (d) ensure compliance with environmental impact assessment procedures; (e) monitor the state of the environment in Sierra Leone; and (f) promote effective planning in the management of the environment.
Furthermore the Act, among other things: prohibits the undertaking of any project set out in the First Schedule to this Act without a valid licence, sets out procedures and criteria for environmental impact assessment, provides for the monitoring of projects by the Agency, places restrictions on the importation and use of ozone-depleting substances, empowers the Agency to issue Enforcement Notices in respect of activities posing a serious threat to the environment, provides with respect to offshore facilities and grants regulation-making powers to the Board of Directors of the Agency.
