Abstract
This Act amends the Criminal Code and establishes rules for the implementation of the Convention on the prohibition of the development, production, stockpiling and use of chemical weapons and the destruction of such weapons. The Act details the following relevant terms: chemical weapons; toxic substances and their precursors, with the exception of those intended for purposes not prohibited under the Convention; ammunition and equipment specifically designed to cause death or other harm through the toxic properties of the toxic chemicals; toxic substances; old and abandoned chemical weapons; production and processing of chemical substances; import and export of chemical substances; pesticides. The Act specifies the following prohibited activities: developing, producing, otherwise acquiring, transporting, financing the purchase of chemical weapons; engaging in military preparations for the use of chemical weapons; assisting, encouraging or inducing anyone in any way to engage in any activity prohibited to a Member State pursuant to the Convention. The Act specifies the following permitted activities: developing, producing, otherwise acquiring, transporting, financing the purchase of the toxic substances used for peaceful purposes and specifically for research purposes, industrial, agricultural, medical, pharmaceutical purposes; protection purposes against toxic substances and chemical weapons; military purposes unrelated to the use of chemical weapons; maintaining public order, including the suppression of domestic riots. Further matters covered by this Act include: chemical weapons production facility; exemptions granted by the Minister of Public Health for production and transfer of toxic substances; procedures for transfer and export of toxic substances; assistance, in the context of protection against chemical weapons, from the the Organisation for the Prohibition of Chemical Weapons regarding protective equipment, decontamination equipment and decontaminants, medical antibodies as well as their use and application, assistance in the destruction of chemical weapons; establishing a monitoring system; establishing guidelines and procedures in connection with granting exemptions from the prohibitions contained in the Act; inspection; criminal provisions and amendment of the Criminal Code.
