Abstract
This Act makes provision for a wide range of measures for the protection of plants, plant reproduction material and timber against diseases and pests including noxious weeds, insects (including honey bees), alien animals and mushrooms. The Act also provides for the establishment of the Nursery Registration Board and the registration of nurseries with the Board.
No person shall sell any plant from a nursery unless that nursery is registered and the plants are properly labelled and certified. The Act grants powers to inspectors to inspect and quarantine nurseries and to the Principal Secretary of the Ministry responsible for Agriculture to declare an area to be an area where owners or occupiers shall take prescribed measures in respect of plants infected with the insect or plant disease or in respect of alien animals, i.e. any vertebrate animal which is not indigenous or native to Swaziland. The Act further regulates the importation of plants, plant diseases, insects and alien animals listed in the Schedules to this Act and the exportation of plants and plant materials. Other provision of the Act concern the control of the mushroom industry, the control of noxious weeds and insect pests in timber (including control on importation), control of locusts, powers of inspectors and offences.
