Abstract
This Act contains provisions for the prevention, introduction and spread of plant pests and to facilitate trade in plants and plant products in accordance with the provisions of the International Plant Protection Convention. Under section 3 the Act establishes the National Plant Health Inspectorate Service (NPHIS) and provides for its functions, appointment of inspectors and functions, and powers. The Act also establishes that the unit may declare a pest to be a quarantine pest o a regulated non-quarantine pest based on pest risk analysis.
Under section 9 any person who suspects or has knowledge about the presence of a quarantine pest in the country shall immediately notify the unit through the nearest inspector or by any other appropriate means. Section 10 clarifies measures to be taken in cases of quarantine pest outbreak, the unit may also declare that area a quarantine area. Control measures must be adopted for area or premises infested or suspected to be infested by a quarantine pest or any buffer zone, pest free area or arca of low pest prevalence (section 12). Other declarations are: Declaration of pest free areas and Declaration of areas of low pest prevalence.
Regarding the import section 16 regulates Phytosanitary measures, and section 17 contains provisions on import permit. Section 19 concerns inspections at port of entry. Similarly for export section 21 regulates phytosanitary certificate for export. Section 24 and 25 are offences and penalties.
