Abstract
This Act provides for the making of agricultural standards in order to facilitate the export of Thai agricultural and food products to the countries that have applied strict sanitary measures.
The Act provides for the establishment of the Agricultural Standards Committee to take charge of establishing policies for the implementation of agricultural standards. In order to set a standard for any agricultural commodity, the committee will appoint a technical committee to draft the standard for implementation.
Agricultural standards may be either mandatory standards or voluntary standards. Producers, exporters or importers of agricultural commodities regulated under mandatory standards issued by Ministerial Regulation are required to obtain a licence from the National Bureau of Agricultural Commodity and Food Standards before undergoing their activities. They are also required to apply for inspection and certification for approval to the conformity assessment service provider. Producers, exporters or importers of agricultural commodities regulated under voluntary standards issued by Ministerial Notification will only need to apply for inspection and certification for approval.
The Act further provides for: procedures and requirements for obtaining a licence to be a conformity assessment service provider; powers and duties of conformity assessment service providers; standard certification marks; the right to appeal to the Committee; penalties; etc.
