Law No. 46 “On state protection and support of entrepreneurship in the Republic of Tajikistan.”

This Law defines the general provisions of state protection, support and free development of entrepreneurship in the Republic of Tajikistan, establishes forms and methods of state stimulation and regulation of the activities of business entities. Entrepreneurship is an activity carried out independently at their own peril and risk by persons registered in this capacity in the manner prescribed by law, aimed at regularly receiving profit from the use of property, production, sale of goods, performance of work and provision of services. A license is a document issued to a legal entity or individual entrepreneur by an authorized body to carry out a certain type of activity within the time period specified in it. An entrepreneur can carry out any type of business activity in accordance with the constituent documents, unless they are prohibited by regulatory legal acts of the Republic of Tajikistan. The entrepreneur carries out government orders on a contractual basis. Taking into account personal and public interests, an entrepreneur must carry out his activities in the following directions: (a) in order to reduce unemployment and increase the standard of living of the population, take measures to create additional jobs in various sectors of the economy, including agriculture; (b) take the necessary measures to organize production, especially for the processing of agricultural commodities and their supply to the domestic and foreign markets; and (c) comply with current regulations on ecology, environmental protection, sanitary conditions, public health protection, safety precautions and standards.
