Abstract
This Law establishes the legal basis for state regulation of the ensuring fertility of agricultural land. Fertility of agricultural land shall be intended the ability of soil to meet the needs of agricultural plants (crops) in nutrients, air, water, heat, biological and physical and chemical environment and to ensure the productivity of agricultural plants (crops). State regulation of fertility of agricultural land shall be intended establishment of standards, norms, rates, rules, provisions in the field of ensuring fertility of agricultural land. Ecological and biological measures shall be intended a set of scientifically substantiated measures for the use of biological factors and means (crop rotation, organic fertilizers, compost, stimulants (pathogens), fossils (minerals), green manure), with a view of increasing fertility of agricultural land. Agroecological arrangements shall be intended creation by artificial means and preservation of the ecological balance of pastures, orchards and protection of protection forest belts for the purpose of sustainable production of agricultural commodities. The competence of the Government of the Republic of Tajikistan in the field of fertility of agricultural land includes: (a) implementation of state policy in the field of ensuring fertility of agricultural land; (b) approval of state programs for ensuring fertility of agricultural land; (c) approval of standards, norms, rules and regulations for agrotechnical, agrochemical, ecological and biological, meliorative, phytosanitary and anti-erosion measures; (d) coordination of the activities of the relevant national bodies and local executive bodies of state power in the field of ensuring fertility of agricultural land; (e) determination of the procedure for the implementation of state control over ensuring fertility of agricultural land; (f) nomination of the authorized state body of the Republic of Tajikistan in the field of fertility of agricultural land and approval of its statute; and (g) implementation of other competences stipulated by the legislation of the Republic of Tajikistan in the field of fertility of agricultural land. Land users shall have the right: (a) to conduct agrotechnical, agrochemical, ecological and biological, land reclamation, phytosanitary and anti-erosion measures aimed at the reproduction of soil fertility of agricultural land; and (b) to receive in accordance with the procedure established by the Government of the Republic of Tajikistan information on the state of fertility of soil on their land plots and the dynamics of changes of its condition. Land users shall have the duty: (a) to use methods for the production of agricultural commodities that contribute to the restoration of agricultural land fertility and the protection of the environment; (b) to observe the standards, norms, rates, rules and regulations for agrotechnical, agrochemical, ecological and biological, ameliorative, phytosanitary, anti-erosion measures; (c) to submit information on the use of agrochemicals, biological factors and means and pesticides to the relevant executive authorities in accordance with the procedure established by the normative legal acts of the Republic of Tajikistan; (d) to promote the implementation of agrochemical, ecological and biological, phytosanitary and ecological and toxicological soil surveys of agricultural land; (e) to inform the relevant executive authorities of the cases of degradation of agricultural land and soil contamination on land plots in their use; and (f) to perform other duties stipulated by normative legal acts of the Republic of Tajikistan. This Law consists of 6 Chapters divided into 25 Articles. Chapter 1 lays down general provisions. Chapter 2 establishes the competence of state executive bodies in the field of ensuring fertility of agricultural land. Chapter 3 establishes rights and duties of land users in the field of ensuring fertility of agricultural land. Chapter 4 regards state regulation in the field of ensuring fertility of agricultural land. Chapter 5 regards state support of activities in the field of ensuring fertility of agricultural land. Chapter 6 lays down final provisions.
