Abstract
This Law is aimed at increasing the requirements for moral and business qualities of a civil servant and establishes general ethical standards and rules of conduct for a civil servant for worthy implementation of his professional activity. Requirements for anti-corruption behavior of state employees shall be as follows: (a) civil servants should not allow actions (inaction), making it difficult for individuals and legal entities to exercise their rights and legitimate interests; (b) civil servants should not use their official powers and related opportunities to benefit from property or services of a non-property nature, other property rights; (c) civil servants in the performance of their official duties should not allow the personal interest of a civil servant, which leads or may lead to a conflict of interest. Civil servants should take measures to prevent conflicts of interest. In the event of a conflict of interest, a civil servant is obliged to take measures to prevent and resolve it, provided for legislation of Turkmenistan. A civil servant is obliged to resist manifestations of corruption, not to commit corruption-related offenses or acts, associated with corruption or creating conditions for corruption. State employees are obliged to notify executive management of the state body in which they work, the prosecutor's office or other state bodies about all cases of appeal to them by any persons in order to induce them to commit corruption-related offenses. Civil servants must suppress offenses related to corruption by other civil servants. A civil servant with reliable information about offense of corruption, must take the necessary measures to prevent and terminate such an offense, also by informing his/her immediate supervisor in writing, and also authorized state bodies. The head of a state body is obliged to take action on applications of a civil servant on corruption-related offenses, cases of persuading him/her to commit such offenses, also by organizing inspections and sending these appeals to authorized government bodies. The head of the state body is obliged to take measures to protect a civil servant reporting credible cases of corruption offenses, inducing him/her to commit such offenses, from persecution, infringing on his rights and legal interests. Upon presentation to a civil servant of an unjustified accusations of corruption, he/she has the right to take measures to refute it. State employee, endowed with organizational administrative powers in relation to other state employees is obliged to take measures to prevent corruption.
