Regulation concerning inspection of health claims.

The purpose of this Regulation is to provide a high level of consumer protection through inspection of health claims concerning products to be delivered to the final consumer. This Regulation shall not apply to medical products for human use, medical devices and foods for special medical purposes and underlines that without prejudice to the special legislative provisions regarding the products, health claims cannot be used on products other than food and food supplements. It lays down the procedures and principles regarding inspection, examination and investigation of health claims of products and promotion and/or sales activities and promotional materials; liabilities of product owner and promoter; and administrative sanctions for the breach of the provisions of this Regulation. The Turkish Medicines and Medical Devices Agency has the powers to stop product promotion and/or sales activities contrary to the provisions of this Regulation, and suspend placing on the market, collect, recall and destruct products and/or promotional materials.
