Abstract
This Rule sets forth basic procedures for the implementation of Law No. 6968 of 1957.
The list of plants that are not allowed for importation and plants that are allowed to be imported under certain conditions will be prepared by the Ministry of Agriculture. Prohibited plants can not be imported for any reason, except that permission can be granted to relevant public institutions for scientific studies. Those who wish to import plant shall apply to the Ministry of Agriculture for an import license. Application procedures are outlined in detail. A license is not required for plants that are brought in by travelling passengers, but the plants will be examined at the port of entry. Examination of imported plants will be made at the port of entry. Depending to the species examination can also be made at other relevant locations. Rejected plants will be returned to the original port or destroyed if deemed absolutely necessary. Companies exporting plants should apply to the Agricultural Quarantine Administration to have the goods examined and acquire Certificate of Origin and Health. For plants that do not require a Certificate of Origin and Health, an "Export Consent Certificate" certifying that examinations are carried out, shall be released. A "Provisional Health Certificate" will be released to fresh vegetable and fruit exporters after a preliminary examination to be carried out before packing. This certificate will be handed over to the examination officer during final examination to be exchanged with the "Certificate of Origin and Health". This Certificate of Origin and Health is valid for 10 days for fresh vegetables and fruits and 20 days for cereals and legumes.Transit consent is necessary for plants to be transited over the Country.The Ministry of Agriculture can prohibit or restrict planting or can apply certain conditions in the case of threat of disease. A list of diseases that shall be notified on occurrence is prepared and announced by the Ministry of Agriculture. Notification and follow-up procedures are given in detail.
