Abstract
The purpose of this Regulation is to ensure consumer protection and human health, including the protection of consumer interests and fair practices in food trade, taking into account, the protection of the environment. This Regulation provides for: (a) a list of food additives in Appendices II and III, (b) conditions of use of food additives in foods, including in food additives, food enzymes and in food flavorings, and (c) rules on the labelling of food additives sold as such. It lays down provisions on the lists of food additives; prohibition of non-compliant food additives and/or non-compliant food; general conditions for inclusion and use of food additives in the lists; specific conditions for sweeteners and colours; functional classes of food additives; the content of the lists of food additives; changes in the production process or starting materials of a food additive already included in a list; food additives produced from genetically modified organisms; specifications of food additives; use of food additives in unprocessed foods; use of food additives in foods for infants and young children; use of colours for markings; carry-over principle; traditional foods; labelling of food additives intended and not intended for sale to the final consumer; general labelling requirements for food additives not intended for sale to the final consumer; the labelling requirement for foods containing certain food colours; and administrative sanctions for the breach of the provisions of this Regulation.
Only food additives included in Annex II may be placed on the market as such and used in foods under the conditions of use specified therein, and only food additives included in Annex III may be used in food additives, in food enzymes and in food flavourings under the conditions of use specified therein. Food additives in Annex II shall be listed on the basis of the categories of food to which they may be added, and food additives in Annex III shall be listed on the basis of the food additives, food enzymes, food flavourings and nutrients or categories thereof to which they may be added. This Regulation compels the producers or users of a food additive to inform the Ministry immediately of any new scientific or technical information which might affect the assessment of the safety of the food additive. This Regulation has been drafted in line with the Regulation (EU) No. 1333/2008.
