Abstract
Comprehensive Act relative to principles of environment management and protection and making provision for the establishment of the Environmental Management Authority (sect. 6), the Environmental Trust Fund (sect. 72) and the Environmental Commission (sect. 81), the last being a special tribunal on matters regarding the environment.
The 95 sections of this Act are divided into 9 Parts: Preliminary (I); Establishment and Organization of the Environmental Management Authority (II); Functions and Powers of the Authority (III); Rules and Public Participation (IV); Environmental Management (V); Compliance and Enforcement (VI); Environmental Trust Fund and Finances (VII); Environmental Commission (VIII); Miscellaneous (IX).
Sections of Part 5 are placed under Headings: General (sects. 31-34); Assessment of Environmental Impacts (sects. 35-40); Protection of Natural Resources (sects. 41-46); Pollution and Hazardous Substances (sects. 47-48).
The last Heading is again divided into: Air and Noise Pollution; Water Pollution; Wastes and Hazardous Substances and Spills. Section 34 makes provision for an environmental incentive programme and section 35 provides for a list of activities requiring a certificate of environmental clearance to be designated by the Minister.(96 sections)
