Abstract
These Regulations are made under the Deep Sea Fishing Authority Act and shall apply to fishing and related activities in the Exclusive Economic Zone of the United Republic. The Regulations make provision for a wide variety of matters relating to fish conservation and management measures, protection of the marine environment and relating to the Deep Sea Fishing Authority.
The Director General of the Authority shall appoint licensing officers, the duties of which are prescribes by these Regulations. The Director General may issue - (a) a licence for foreign fishing vessel, (b) a licence for local fishing vessel, or (c) special licence. A special licence shall entitle the holder to engage in fishing for, scientific and educational purposes or the supply of food in case of an emergency where no other adequate food supply is available. A licence shall be issued under these Regulations subject to payment of fees prescribed in the Second Schedule. One or the conditions of a licences is that fish caught under such licences shall be landed in a designated port. Intention to land fishery resources in any designated port shall be notified in advance to the Director General. Inspector evaluate whether there is reasonable evidence for believing that a vessel has engaged in, or supported illegal, unreported and unregulated fishing. Rare fish and seabird species listed under the Convention on International Trade on Endangered Species and any other Convention which the United Republic is a party are not caught and in case of incidental catch be returned to the sea as soon as possible. A person who wishes to conduct fishing in the Exclusive Economic Zone of the United Republic shall apply for a licence and registration of Automatic Location Communicator to the Director General. A register of each type of licences issued and particulars of licensed fishing vessels shall be kept.
A person exercising jurisdiction under these Regulations shall, in relation to any decision, order, exercise of any power or performance of any function, be guided by the following principles – (a) precautionary principle; (b) the polluter pays principle; (c) the principle of ecosystem integrity; (d) the principle of international cooperation in management of fishery resources; and (e) the principle of public participation. The Director General shall carry out fish stock assessment and may impose measures for restoration of fish stocks in order to ensure sustainability of the fishery resources. The Regulations prohibit water pollution and degradation of marine environment.
The Minister shall, for the purpose of exportation of fishery resources and in accordance with any bilateral, regional or international arrangement, impose or prescribe conditions, specifications or any requirement on any matter of fishery resources to be exported including processing establishments and shall, in consultation with the Minister responsible for fisheries of Zanzibar, designate a competent authority for these purposes.
Other provisions of these Regulations concern, among other things: a Vessel Monitoring System and other monitoring control and surveillance measures; administration of the authority; capacity building, awareness and research; offences and penalties (including unlawfully possesses shark fins).
