Abstract
These Rules, made under section 40 of Energy and Water Utilities Regulatory Authority Act, govern matters related to tariff application, rate setting and approvals in water sector, electricity and natural gas sub-sectors in Tanzania Mainland. A licensee shall apply to the Authority for tariffs pursuant to these rules and the respective sector Tariff Application Guidelines prepared by the Energy and Water Utilities Regulatory Authority (EWURA). Tariff review applications shall be prepared by licensees in accordance with the tariff application format prescribed in the guidelines prepared by the Authority. The Authority, on its own motion, may initiate an inquiry to review a tariff of any licensee in specified circumstances. A licensee may submit to the Authority an emergency tariff application to address an emergency situation.
The Authority shall conduct an inquiry before exercising power to regulate any rate or charges. The evaluation of the application shall be done against specified criteria and tariff setting shall follow a prescribed methodology. The Authority shall, after due consideration of all material facts to the application, issue a Tariff Order prescribing the approved tariff and charges to be applied by the applicant in providing regulated services. Any person who is aggrieved by the decision of the Authority made under these Rules may appeal to the Tribunal pursuant to the provisions of the Fair Competition Act.
