Abstract
These Regulations contain a variety of rules relative to the coffee industry in Tanzania including the growing and processing of coffee beans and the trade in coffee. They also provide with respect to quality control, contract farming, husbandry related to coffee growing and a stakeholders forum and other participation mechanisms.
These Regulations shall apply to any type or grade of coffee grown or brought into Tanzania for trade purposes, but shall not apply to coffee on transit. The Tanzania Coffee Board shall keep a register of all coffee growers for specified purposes. It shall also keep control of coffee nurseries and coffee plantations for various specified purposes including pest prevention. A coffee grower shall properly maintain his or her land planted with coffee trees in accordance with good coffee husbandry practices prescribed under these Regulations or guidelines issued by extension or agricultural officers and shall not uproot or destroy coffee trees without approval of the Board. Coffee seeds shall not be import unless in accordance with the provisions of the Seed Act.
Every licensed coffee processor shall ensure that the processed coffee conforms to grades specified in the Fifth Schedule of these Regulations. Restrictions on buying of coffee require a coffee dealer registered under these Regulations to purchase coffee from a registered grower within registered buying post or auction. The Board shall declare buying seasons and buying posts. No person shall export coffee except under a licence issued by the Board, which shall organise coffee auctions. A coffee grower, trader, processor, exporter shall maintain quality of coffee to meet its standard as provided for in these Regulations.
There shall be an annual stakeholders meeting composed of key stakeholders from the coffee industry. Contract farming may be entered into between a registered coffee grower and financier on the basis of a standard form of contract as provided by these Regulations. Local Government Authorities may, in the implementation of the shared functions agreed by stakeholders, make by-laws. The Board shall, in consultation with other stakeholders, develop coffee industry strategy in which it shall draw its strategic action plan. Appeal against decisions of the Board may be had with the Minister. The Regulations also provide for the resolution of disputes.
