Abstract
These Regulations, comprising 22 articles and 2 Schedules, apply to matters related to water fees application, setting, and approvals in the management of the water resources by the Board in the Tanzania Mainland. The Basin Water Board is responsible for ensuring the installation of cumulative flowmeters at water abstraction points by permit holders, who bear the installation cost, to measure water quantity and manage usage data, with existing holders having two years to comply and new applicants needing to install them before permit issuance. Part III of these Regulations details the fee-setting framework for water use and wastewater discharge. It specifies uniform units of measurement for calculating fees across various activities (e.g., cubic meters for abstraction, square meters for impoundment). The Basin Water Board will bill permit holders annually based on permitted quantities, conducting assessments, and potentially imposing a 5% monthly interest on overdue payments. Fees are categorized, and the Board can impose them for activities like water abstraction, wastewater discharge, and permit granting, using either flat rates (for usage below a set threshold) or volumetric rates (for usage exceeding it). The Board must consider factors like geographic location, water conservation, compliance with standards, and economic value when setting fees, and it utilizes a revenue requirement methodology. The process for setting and reviewing fees involves stakeholder consultation and approval from the Basin Board and the Director. Finally, the Board can require performance bonds for high-risk activities and is mandated to develop cost-efficient mechanisms for revenue collection, including electronic payment systems. Part IV deals with offences. In the First Schedule are detailed the Water User Categories, while the Second Schedule includes the Format for Water Use and Discharge Fees Proposal.
