Abstract
This Act makes provision with respect to the management, use and protection in Tanzania of water resources, i.e. water courses, surface water, groundwater and estuary waters. The Act sets out fundamental principles of water use and conservation. It also states preferences in water allocation.
The Minister shall be the principal administrative authority of this Act but he or she may delegate functions and powers to the Director of Water Resources, who has also been assigned certain functions directly by this Act. The Minister shall establish catchment and sub-catchment areas and shall establish Basin Water Boards. The National Water Board, established by this Act, shall have mainly advisory functions.
The Act makes provision for, among other things: water resources classification; control of groundwater; prevention of water pollution; environmental impact assessment; water abstraction and use; flood managemen; establishment, registration and functioning of water user associations; protection biological diversity and especially aquatic ecosystems, and policies, strategies and legislation in respect to transboundary waters.
