Decree No. 963 of the Cabinet of Ministers validating the Methodology for calculation of the amount of damage caused by unauthorized occupation of land plots, not for intended purposeful use thereof, and removal of soil cover (fertile soil layer) without special authorization.

This Methodology is aimed at calculation of the amount of damage caused to the state, territorial communities, legal entities and natural persons, applicable to all categories of land caused by unauthorized occupation of land plots, not for intended purposeful use thereof, and removal of soil cover (fertile soil layer) without special authorization unauthorized occupation of land, use of land for other purposes, removal of soil (fertile soil layer) without special permission. The amount of damage is determined separately for each of the aforesaid offences. The amount of damage does not include the cost of: (a) demolition of houses, buildings and structures that are spontaneously constructed or are being built on arbitrarily occupied land plots or on land plots not allocated in the prescribed manner for this purpose; (b) bringing land into a condition suitable for the further use thereof for its intended purpose; and (c) reclamation of disturbed lands. The Decree establishes calculation formula.
