Abstract
This Law defines the legal status of the National Commission, which carries out state regulation in the spheres of energy and communal services, its tasks, functions, powers and the procedure for their implementation. The National Commission, which carries out state regulation in the spheres of energy and communal services, is a permanent central body of executive power with a special status, which is formed by the Cabinet of Ministers of Ukraine. The specifics of the special status of the Regulator are determined by its tasks and powers, and are determined by this Law and other legislative acts and consist, in particular, in the peculiarities of the organization and procedure of the Regulator's activities, in the special procedure for appointing the members of the Regulator and terminating their powers, in the special procedural principles of the Regulator's activity and guarantees of independence in his decision-making within the limits of the powers defined by law. The Regulator is a legal entity under public law. The Regulator carries out state regulation, monitoring and control over the activities of business entities in the field of energy and communal services, in particular: (1) in the field of energy: (a) activities of generation, transmission, distribution, distribution by small energy generation and transmission systems, supply of electric energy, energy storage, aggregation; (b) activities related to the organization of the purchase and sale of electric energy on the day ahead and intraday market, ensuring the purchase of electric energy at the "green" tariff, trading activities; (c) transportation, distribution, storage (injection, selection), provision of LNG installation services, supply of natural gas; and (2) in the field of communal services: (a) activities for the generation of thermal energy at heat-generating installations, including installations for the combined production of thermal and electric energy, its transportation through trunk and local (distributive) thermal networks, supply of thermal energy in volumes exceeding the level established by the conditions and rules of economic activity (licensing conditions); and (b) activities in the field of centralized water supply and sewerage in volumes exceeding the level of the established by the conditions and rules of economic activity (licensing conditions).
