Abstract
This Act grants the force of law in Uganda to the Treaty Establishing the Common Market for Eastern and Southern Africa taking into consideration the gender dimensions. The Treaty is set out in the Schedule to this Act. In addition, subject to the Treaty, Regulations made by the Council of Ministers of the Common Market under Article 10 of the Treaty shall have the force of law in Uganda. In any proceedings in Uganda, any question as to the meaning or effect of any provision of the Treaty or as to the validity or meaning or effect of a Common Market instrument shall be treated as a question of law and if not referred to the Court of Justice of the Common Market, it shall be determined in accordance with the principles laid down by the Treaty and any relevant decision of the Court of Justice. A judgement or order of the Court of Justice which imposes a pecuniary obligation on a person shall, upon verification as required by article 40 of the Treaty, be enforceable in Uganda.
