Abstract
This law is Miscellaneous Amendments Act and is designed in 38 Sections and has 6 Schedules. This law is amending various laws in Uganda including the followings: Article 12 provides that the Administration of Estates (Small Estates) (Special Provisions) Act is amended by repealing section 7(2).
The Fisheries and Aquaculture Act, 2023 has been amended to introduce a new Section 79A, which imposes a fish levy on all fish exports originating from Ugandan waters. The levy includes specified rates for different categories, such as USD 0.05/kg for large fish, 8% of value for fish bladders, and USD 0.02/kg for small pelagics and industrial by-products, payable to the Uganda Revenue Authority at the time of export.
The Land Act, Cap. 227 has been amended by removing the definition of “Commissioner” and introducing a new definition for “Registrar of Titles” as defined under the Registration of Titles Act. Additionally, all references to “Commissioner” throughout the Act are replaced with “Registrar of Titles”.
The Registration of Titles Act, Cap. 230 has been amended to replace the definition of “Commissioner” with a new definition of “Registrar,” encompassing the Registrar of Titles and their deputies or assistants. Section 3 is substituted to formally establish the appointment process and roles of the Registrar, Deputy Registrar, and Assistant Registrars of Titles, aligning it with public service laws. A new section also validates past actions taken by authorized officials from March 18, 2004, to the present, ensuring their legal standing despite prior definitional inconsistencies.
The Hides and Skins (Export Duty) Act, Cap. 339 has been amended to impose a levy of US$0.80 per kilogram on raw hides and skins exported from Uganda, including those exported for outward processing. This levy does not apply to imported hides and skins, and exemptions are provided for items listed in the Second Schedule. Additionally, several outdated provisions, including section 6(1), references to the “first” and “second” schedules, and the First Schedule itself, have been repealed.
The Access to Information Act, 2005 has been amended to include "Parliament" alongside "Government" in section 2(1), thereby extending the Act's scope to cover access to information from Parliament.
The Common Market for Eastern and Southern Africa (COMESA) Treaty (Implementation) Act, 2017 has been amended to define "import duty" in line with the East African Community Customs Management Act. A new section 5A exempts goods from COMESA member states from import duty if they meet origin requirements and reciprocal tariff preferences are granted to Ugandan exports. However, this exemption does not apply to specific listed products or goods from EAC Partner States that do not qualify as East African Community goods.
