Abstract
These Regulations provide for the procedure of environmental impact assessment of projects listed in the Third Schedule to these Regulations and major repairs, extensions, or routine maintenance of existing projects included in the Schedule (reg. 3). The Regulations aim to ensure that projects are environmentally sound and sustainable, and that adverse impacts are minimized or mitigated. The Technical Committee on Environment Impact Assessment established under section 11 of the Environment Statute of 1995 shall provide advice to the Board and Executive Director of the National Environment Management Authority on technical issues related to environmental impact assessment (reg. 4).
The Regulations describe the steps and requirements for preparing and submitting project briefs, environmental impact studies, and environmental impact statements for projects that may have significant impacts on the environment, as well as the review and approval process by the National Environment Management Authority (NEMA) and the lead agencies (reg. 6 to 28).
Part VII outlines the provisions for inviting and receiving public comments, holding public hearings, and accessing EIA documents and information, as well as the protection of proprietary information (reg. 29 and 30). Part VIII further explains the obligations of the developers to conduct self-auditing and comply with the mitigation measures, and the powers of the NEMA inspectors to carry out audits and enforce compliance.
Part IX covers issues such as the EIA of policies and similar projects, the effect and cancellation of approval, the offences and penalties, the fees, the appeals, and the delegation of powers and functions.
