Abstract
This Act repeals and replaces the Uganda Coffee Development Authority Act, Cap. 325. Its objective is to continue in existence the Uganda Coffee Development Authority and to provide for it to regulate, promote and oversee the coffee subsector, including all on-farm and off-farm activities in the coffee value chain, with a view to facilite its competitive, participatory and sustainable dvelopment. The Act also provides for a coffee auction system.
The Act consists of 11 Parts and 2 Schedules. After a preliminary Part 1, covering interpretation issues and detaling the purpose of the Act, Part 2 describes the objectives, composition, powers and functions of the Coffee Development Authority, including procedural matters. Part 3 is dedicated to the staff of the Authority ( the Managing Director and the Secretary of the Board).
Parts 4 and 5 are about the Registration and the Licensing of the coffee value chain actors.
Part 6 dedicated to the types, varieties and grading of coffee (their promotion and their profiling, grading and certification) and Part 7 is dedicated to the promotion of the value addition and the domestic consumption of coffee.
Part 8 regulates the finances related to coffee, in particular the funds of the Authority, the levy on coffee exports, the authority to operate on sound financial principles, accounts and audit.
Part 9 establishes that the Authority shall, in coordination with the National Agricultural Research Organisation oversee the formulation of a National Coffee Research and Development Agenda to guide the coffee research, which is further regulated here. The Authority also establishes a coffee auction system.
The text is terminated by the last two Parts: Part 10 on miscellaneous issues (protection from liability for members of the Authority acting on its directioms, offences and penalties, obligation to sign a MoU to warehouse coffee for export) and Part 11 on repeals, savings and transitional issues.
