Abstract
The Physical Planning Amendment Act, 2020 significantly modifies the Physical Planning Act, 2010 by expanding the powers and functions of the National Physical Planning Board, including establishing a secretariat led by an Executive Director. It introduces new sections to safeguard the right to a clean and healthy environment, streamlines the composition of planning committees at various local government levels, and enhances enforcement powers including demolition of unauthorized constructions. The Act also mandates preparation and publication of physical development plans, incentivizes compliance through rewards and certificates, and enforces penalties for breaches. Further, it strengthens financial management and accountability mechanisms for the Board, revises appeal processes, and promotes public participation and expert engagement in planning.
