Abstract
These Regulations of this Subpart, issued under the authority of the Atlantic Tunas Convention Act of 1975 (ATCA), the Magnuson-Stevens Fishery Conservation and Management Act, the Tuna Conventions Act of 1950, and the Antarctic Marine Living Resources Convention Act of 1984, concern the control on the international trade in regulated fish and the collection of catch and landing documentation for specified seafood species. They require importers and exporters to possess a valid International Fisheries Trade Permit (IFTP) and to file all data sets, reports, and documentation as required under the specified programs and establish a Seafood Traceability Program. The Seafood Traceability Program has data reporting requirements at the time of entry for imported fish or fish products and recordkeeping requirements for fish or fish products entered into U.S. commerce. The data reported and retained will facilitate enforcement of section 307 of the Magnuson-Stevens Act and the exclusion of products from entry into U.S. commerce that are misrepresented or the product of illegal or unreported fishing. The data reporting and recordkeeping requirements under the program enable verification of the supply chain of the product offered for entry back to the harvesting event(s). In addition, the permitting requirements of these Regulations pertain to importers of products within the scope of the Program. Information as specified shall be provided by importers. Shark and tuna species are covered by the Program.
