Abstract
This Part 452 prescribes the procedures to be used by the Secretary when examining applications for exemption from section 7(a)(2) of the Endangered Species Act. The Part focuses on: threshold review and Secretary’s determinations on the conduction of any biological assessment of application; content of Secretary’s report; conduct of hearings; parties and intervenors; separation of functions between Administrative Law judge and the technical staff; joint proceedings.
