Ordinance No. 8 of the State Inspection for Plant Quarantine under the Cabinet of Ministers validating the Regulation on the procedure for seizure, return and destruction of products under quarantine.

The requirements of this Regulation shall be mandatory for legal entities and natural persons engaged in import, export, transit, production, procurement, storage, transportation, processing and trade of regulated products. Regulated products are confiscated in the following cases: (a) when plant quarantine objects are identified; (b) when are identified planting materials and products prohibited for import into the territory of the Republic of Uzbekistan; and (c) in the absence of appropriate documents for regulated products (quarantine permit for plants and products requiring a quarantine permit, phytosanitary certificate or certificate issued by the competent government authorities of a foreign state). When removing products from quarantine, the state plant quarantine inspector draws up two copies of the document on the removal of products from quarantine in accordance with Appendix 1. One copy of the removal act is handed over to the owner of the regulated products (his representative or recipient, carrier), and the second copy remains with the state plant quarantine inspector. Samples of regulated products seized by the state plant quarantine inspector are selected and sent to the appropriate laboratory for testing. Upon presentation of the exported regulated products with the relevant documents and (or) upon the conclusion of a laboratory examination, if there are no plant quarantine organisms in it, it is immediately returned to the owner of the cargo (his representative or recipient, carrier) based on the instructions of the state plant quarantine inspector. Quarantine and regulated products contaminated with dangerous pests, plant diseases and weeds must be destroyed (by burning in a special place or deep digging) if it is impossible to neutralize them and send them back to the consignor.
