Circular No. 52/2013/TT-BNNPTNT on detailed Provisions for the Implementation of Government's Decree No. 80/2012/Nd-Cp of 8 October 2012 on Management of Fishing Ports.

This Circular, consisting of 9 articles and seven Appendixes, provides for the Implementation of Government's Decree No. 80/2012/Nd-Cp of 8 October 2012 on Management of Fishing Ports. This Circular specifies details of: Point b, Clause 1 and Point b, Clause 2, Article 4; Clause 3 of Article 7; Clause 3 of Article 8; Clause 4, Article 14; Point a, Clause 9, Article 14; Clause 1 of Article 19; Clause 6 Article 21 of the mentioned Decree. This Circular applies to Vietnamese and foreign organizations and individuals with activities related to fishing ports and storm shelters for fishing vessels within Vietnam. Article 2 deals with detailed provisions of Point b, Clause 1 and Point b, Clause 2, Article 4, on equipment and cargo handling lines of ports; Article 3 with detailed provisions in Clause 3 Article 7 on the content of decisions to announce the opening of fishing ports; Article 4 establishes detailed provisions of Clause 3 Article 8 on the content of decisions on announcement of fishing ports; Article 5 on detailed provisions in Clause 4 Article 14 on reporting regime and contents; Article 6 on detailed provisions of Point a, Clause 9, Article 14, on the right to lease infrastructure for production, business and fishery services in port areas; Article 7 detailed provisions in Clause 1 Article 19 on the announcement of a list of storm shelters for fishing vessels; Article 8 detailed provisions of Clause 6 Article 21 on Regulation on management of fishing ports and storm shelters for fishing ships; Form of paper used in fishing port management, storm shelter anchorage area for fishing vessels.
The Decree provides for the management of fishing ports, the conditions for the opening and closing of the ports, the conditions for the entering and leaving fishing ports applicable to fishing ships and foreign fishing ships, for responsibilities and rights of fishing port management boards, and for fishing port use charges.
The Decree further provides for the management of storm shelter zones and for the rules applicable to fishing ships in these zones; and for responsibilities of State management agencies.
