Abstract
This Decree amends Government’s Decree No. 160/2005/ND-CP which details and guides the implementation of the Law on Minerals and the Law amending and supplementing a number of articles of the Law on Minerals.
Amendments have been made to various articles dealing with the following matters: powers and responsibilities of ministries in the state management of minerals; mineral exploration, exploitation and use planning; organizations and individuals engaged in mineral activities; regions banned from mineral activities; areas opened to bidding for mineral exploration or exploitation; areas with minerals to be reserved as national mineral resources; areas subject to mineral exploitation; fees for the exclusive right to mineral exploration; responsibilities of provincial-level People’s Committees. Furthermore, in articles 4, 6, 12, 21, 22, 37, 41 and 42 the words “Ministry of Industry” have been replaced with the words “Ministry of Industry and Trade” and in clause 2 of article 6 the words “provincial-level Industry Services” have been replaced with the words “provincial-level Industry and Trade Services”.
