Abstract
This Ordinance constitutes and establishes the Ministry of Agriculture and Fisheries of Samoa a as a department of the Government. It is composed of 16 sections, i.e.: Short title and commencement (sect. 1); Interpretation (sect. 2); Application of Ordinance to exclusive economic zone (sect. 2A); Constitution of Department (sect. 3); Principle functions of the Department (sect. 4); Agriculture and Fisheries (sect. 5); Appointment of other officers and employees (sect. 6); Existing appointments deemed to be made under this Ordinance (sect. 7); Officers to act under the direction of the Director (sect. 8); Delegation of powers of the Minister (sect. 9); Delegation of powers of Director (sect. 10); Powers of Minister (sect. 11); Special investigations (sect. 12); Advisory and technical committees (sect. 13); Annual report (sect. 14); Regulations (sect. 15). The principal functions of the Department include: (a) to promote and encourage the development of all phases of the planting, agricultural, pastoral, and horticultural industries in Samoa; (b) to promote in conjunction with the department of Lands, Surveys and Environment the conservation, production and development of the natural resources of Samoa, especially soil and water and specified principles and objectives; (c) to regulate fishing in Samoa and the territorial waters belonging to Samoa or any part thereof, or in the exclusive economic zone of Samoa; (d) to regulate, control and supervise the manufacture, importation, storage and use of pesticides.
