Abstract
These Regulations of the Head of State, made pursuant to section 15(2)(d) of the Agriculture, Forests and Fisheries Ordinance 1959, establish a Pesticides Technical Committee and provide with respect to the registration, control, and management of all pesticides in Samoa. The Minister shall appoint a suitably qualified person to be the Registrar for the purposes of enforcing these Regulations. A person may not import, manufacture, pack, repack, label, store, sell, distribute, advertise, apply, possess, or use any pesticide unless it has been registered under these Regulations and unless that person has obtained a Pesticide Dealer’s license. An application for a license, or for the renewal of a license, must be made to the Committee. The Regulations also require a Restricted Pesticide Permit to be obtained for trade in a pesticide that is designated by the Committee as a Restricted Pesticide. The Regulations furthermore set out rules for the storage, packing, labelling and handling of pesticides and the disposal of pesticides and provide with respect to advertisement of pesticides, enforcement of these Regulations and offences.
The Committee shall, among other things, advise the Minister on steps needed to implement the FAO International Code of Conduct on the Distribution and Use of Pesticides.
