Abstract
This Act is enacted to replace the Land and Titles Act 1981. The Act provides for recognition and protection of titles in land and various other matters relating to land and land administration and adjudication.
The Act consists of 68 sections divided into 8 Parts: 1.Reliminary; 2. Administration of Act; 3. Customary Land; 4. Matai Titles; 5. Proceedings; 6. Rules of Procedure of the Courts; 7. Village Fono Act Matters; 8. Miscellaneous.
The Ministry responsible for Justice and Courts Administration is responsible for the administration of this Act. The Chief Executive Officer of the Ministry also known as the Court Registrar shall be the Registrar of the Land and Titles First Court, Land and Titles High Court and Land and Titles Court of Appeal and Review. Part III concerns the identification and survey of customary land.
