Abstract
This Act makes provision for rules and measures to prevent marine pollution and to respond to effects causing marine pollution. The Act also defines liability for damage arising from polluting activities including pollution from oil and defines offences.
The Act lists international marine pollution conventions which shall apply under laws of Samoa for purposes of this Act. The Act shall be the principal law dealing with pollution incidents affecting the marine environment where the source of the pollution is a vessel, and shall apply to: (a) all vessels in Samoan waters; and (b) all Samoan vessels.
The Act provides for the establishment of a sub-committee for marine pollution incidents of the Disaster Advisory Committee and the establishment of the National Marine Pollution Fund. The Chief Executive Officer of the Ministry responsible for marine transport shall prepare a National Marine Spill Contingency Plan.
