Abstract
This Act makes provision for the collection, management, recycling and disposal of waste in Samoa. For these purposes, the Act makes provision for the designation of waste management service areas by the Minister and for the designation of approved waste management operators by the Ministry. The Act also requires a permit to be obtained for dumping and incineration of wastes at sea and provides for community involvement in waste management.
The Act defines functions of the Ministry responsible for the environment and powers of the Minister and the Chief Executive Officer of the Ministry. The Act furthermore provides for, among other things: registration and Licensing of waste operators, designation of hazardous waste; environmental standards relating to waste management practices and facilities to be prescribed by the Minister; audit of waste generation and disposal; implementation of relevant international conventions (listed in the Schedule); regulation of incineration of wastes; dumping of prescribed substances; planning; enforcement; offences relating to (hazardous) waste.
