Abstract
Subject to this Act, the Treaties mentioned in Schedule I, i.e. the Antarctic Treaty, the Protocol on Environmental Protection to the Antarctic Treaty, the Convention for the Conservation of Antarctic Seals and the Convention on the Conservation of Antarctic Marine Living Resources and related Protocols and Annexes, shall form part of the law of the South Africa (sect. 3). This Act shall apply in Antarctica to: (a) a South African citizen; (b) residents of the Republic with a few exceptions made; (c) a citizens of another Contracting Party, if immunity of that person has been waived by that Party; (d) any person, whether a South African citizen or not, who is a member of or is responsible for organizing of an expedition to visits Antarctica which has been organized in the Republic, but not the expedition organized by the government of another Contracting Party; (e) legal persons registered as such in the Republic and using any ship, aircraft or vessel registered in the Republic (sect. 2). The Minister is empowered, pursuant to section 4, to undertake actions for the correction of activities undertaken by persons to whom the Act applies in Antarctica. Section 5 provides for designation of inspectors, observers and other officials. The remaining provisions deal, inter alia, with regulation making powers of the Minister (sect. 6) and jurisdiction (sect. 8), and prescribe offences (sect. 9). The Act consists of 14 sections and 2 Schedules.
