Abstract
This Notice of the Minister of Environmental Affiars and Tourism declares the area of South Africa described in the Schedule to be a Whale Sanctuary Marine Protected Area in accordance with section 43 the Marine Living Resources Act and provides some rules relative to the use of vessels in the area. The requirements of a permit for the use of vessels shall not apply to certain vessels including vessels used for commercial or recreational linefishing or harvesting of seaweed.
The Notice limits the application of section 43 (2)(a) of the Act with respect to fishing in specified marine protected areas. It also prohibits the varying of fish by vessels in specified areas. Fishing for whale sharks requires a permit of the competent authority as defined by the Act.
