Abstract
These Regulations implement provisions of the Genetically Modified Organisms Act, 1997, with respect to (an application for) authority to conduct an activity concerning genetically modified organisms and risk assessment of such activities.
An applicant may have to include an environmental impact assessment in accordance with section 78 of the national Environment Management; Biodiversity Act, 2004. Procedures for authorization include advise of the Advisory Committee, registration of facilities, risk assessment of any activity involving genetic modification, application for a permit and public notification of a proposed general or commodity release of GMO’s. The Regulations also provide rules relative procedures to be followed in case of accidents involving GMO’s and appeal in terms of section 19 of the Act.
